By using Aria Platform, you agree to these terms. They cover your rights, responsibilities, and the rules for using our AI automation service.
1. Acceptance of Terms
By creating an account, subscribing to a plan, or using the Aria Platform, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.
2. Service Description
Aria Platform is an AI-powered customer engagement platform that automates WhatsApp and Facebook Messenger conversations, appointment booking, lead management, and customer follow-ups for businesses. The AI assistant operates under your brand persona and follows your configured business rules.
3. Account Responsibilities
- You must provide accurate and complete business information during registration
- You are responsible for maintaining the security of your account credentials
- You must promptly notify us of any unauthorised access to your account
- You are responsible for all activities that occur under your account
- One account per business entity — do not share accounts across separate businesses
4. Acceptable Use
You agree NOT to use Aria Platform to:
- Send spam, unsolicited messages, or marketing to contacts who have not opted in
- Transmit illegal, harmful, threatening, abusive, or defamatory content
- Impersonate another person or business
- Reverse engineer, decompile, or attempt to extract the source code of the platform
- Circumvent usage limits, quotas, or security measures
- Use the platform for any purpose that violates applicable laws in Malaysia, Singapore, Indonesia, or Hong Kong
5. Subscription & Billing
- Plans are billed quarterly in advance via Stripe
- Prices are listed in Malaysian Ringgit (RM) and are subject to change with 30 days’ notice
- Auto-renewal — subscriptions automatically renew unless cancelled before the renewal date
- Plan limits — each plan includes a set number of contacts and AI tokens; overages are billed separately
- Failed payments — we will attempt to retry failed charges; after 3 failures, your account may be suspended
6. Refund Policy
We offer a 14-day money-back guarantee on all plans (except Enterprise). Refunds are subject to conditions including usage limits and applicable fees. For full details, see our Refund Policy and Refund Terms & Conditions.
7. Intellectual Property
- Aria Platform — all platform code, AI models, workflows, and branding are owned by JKY DYNASTY HOLDING SDN. BHD.
- Your data — you retain full ownership of your business data, customer information, knowledge base documents, and conversation history
- AI-generated content — responses generated by the AI assistant on your behalf are yours to use
- Feedback — any suggestions or feedback you provide may be used to improve the platform without obligation
8. Limitation of Liability
To the maximum extent permitted by law, JKY DYNASTY HOLDING SDN. BHD. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.
9. Service Availability
- We aim for high availability but do not guarantee 100% uptime
- Starter and Growth plans — best-effort availability, no SLA
- Scale and Enterprise plans — uptime commitments as specified in your service agreement
- Planned maintenance will be communicated in advance where possible
- We are not liable for downtime caused by third-party services (WhatsApp, Meta, Supabase, Stripe)
10. Termination
- You may cancel your subscription at any time from the billing dashboard
- We may terminate your account for violation of these terms, with notice where practicable
- Upon termination, you may export your data within 30 days
- After 30 days, all your data will be permanently deleted (except audit logs retained for 7 years)
11. Data Protection
Your use of Aria Platform is also governed by our Data Protection Policy and Privacy Policy. We comply with applicable data protection laws across all markets we operate in.
12. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Malaysia. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Malaysia.
13. Changes to Terms
We may update these Terms of Service from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the platform after changes constitutes acceptance.
